Terms of use
The terms of use of the centre's platform: accounts, filing requests, fees, confidentiality and liability.
Scope of These Terms
These Terms govern the use of the electronic platform of the Arbitration and Dispute Resolution Centre of the Gaza Chamber of Commerce, Industry and Agriculture.
The arbitration or mediation proceedings themselves are governed by the Centre's Regulations and Procedural Rules and by the Palestinian Arbitration Law No. (3) of 2000, not by these Terms.
Where these Terms conflict with the Centre's Regulations in respect of pending proceedings, the Regulations prevail.
Account and Capacity
You are responsible for the accuracy of the information provided at registration and for the confidentiality of your login credentials; every operation carried out from your account is attributed to you.
Acting on behalf of a company or of another party requires a valid authorisation; the Centre may request proof of such authorisation at any time.
The Centre may suspend any account that provides misleading information or uses the platform for a purpose other than its intended one.
Electronic Filing and Its Effect
Submitting a request, memorandum or document through the platform produces the same procedural effects as a paper filing under the Regulations, and is established by the date and time of submission recorded in the system.
Electronic signatures on platform documents, authenticated by a verification fingerprint, are recognised in the Centre's proceedings.
The platform's timeline and audit log are the authoritative record of what has taken place on the case electronically.
Confidentiality and Acceptable Use
Case materials are confidential: you may not disclose, outside the proceedings, anything you come to know in your capacity as a party, representative or arbitrator, except as permitted by law.
It is prohibited to upload unlawful content, to attempt to access cases or accounts for which you hold no authorisation, or to disrupt the operation of the platform.
The Centre may remove any infringing content and refer to the competent authorities whatever the law requires to be referred.
Fees and Payment
The fees for the Centre's services are set out in the approved schedule of fees, and numbered invoices for them are issued through the platform.
Any amount refunded is issued by way of a numbered credit note or refund; an issued invoice is never amended.
Delay in paying fees due may result in the proceedings being suspended in accordance with the Regulations.
Limitation of Liability
The platform is a means of administering the proceedings; the Centre does not guarantee uninterrupted connectivity, and you must retain copies of your original documents.
Information displayed on the public pages does not constitute legal advice.
The liability of the Centre, its staff and its arbitrators in connection with the proceedings is governed by the Regulations and by the applicable law.
Governing Law
These Terms are governed by Palestinian law, and any dispute concerning the use of the platform itself shall be heard before the competent authority in Palestine unless otherwise agreed.
Any amendment to these Terms is published on this page and applies to use subsequent to its publication.
